اقتصاد ۲۴- به گزارش روابط عمومی کانون وکلای دادگستری مرکز، متن کامل نامه دکتر محمد شاهمحمدی، رئیس کانون وکلای مرکز خطاب به آنتونیو گوترش، دبیرکل سازمان ملل متحد به این شرح است:
بسمه تعالی

با اهدای سلام و تحیات
بدینوسیله، فرارسیدن بهار طبیعت و آغاز سال نو ایرانی را به جنابعالی صمیمانه تبریک و تهنیت عرض نموده، و در این آستانه نو شدن، استقرار و گسترش صلح، امنیت، آزادی و عدالت را برای تمامی ملل جهان مسئلت مینماییم.
همانگونه که در مکاتبه پیشین نیز به استحضار رسیده است، اقدامات نظامی ایالات متحده آمریکا و رژیم اسرائیل علیه ملت ایران، از منظر حقوق بینالملل، مصداق بارز نقض اصول و قواعد آمره حاکم بر نظم حقوقی بینالمللی، بهویژه ممنوعیت توسل به زور مندرج در بند ۴ ماده ۲ منشور ملل متحد، محسوب میگردد و در عین حال، بیانگر بیاعتنایی آشکار به اهداف و اصول بنیادین سازمان ملل متحد، از جمله مفاد بند ۱ ماده ۱ و بند ۱ ماده ۳۳ منشور، است. افزون بر این، اقدامات مزبور از حیث ماهیت و آثار، با موازین مقرر در ماده ۸ مکرر اساسنامه دیوان کیفری بینالمللی (اساسنامه رم) نیز منافات دارد.
کانون وکلای دادگستری مرکز، بهعنوان قدیمیترین نهاد صنفی، مدنی و مستقل وکالت در ایران، که بر پایه حاکمیت قانون، استقلال نهاد وکالت و پاسداری از موازین حقوقی و انسانی استوار است، وظیفه خود میداند مراتب نگرانی عمیق و اعتراض جدی خویش را نسبت به استمرار این اقدامات غیرقانونی و آثار ویرانگر آن بر صلح و امنیت منطقهای و بینالمللی، به استحضار جنابعالی برساند.
بیتردید، آغاز و تداوم جنگ، نقض یکی از بنیادیترین تعهدات دولتها در نظام حقوق بینالملل معاصر، یعنی تعهد به حفظ صلح و امنیت بینالمللی بهشمار میرود. حمله به اماکن آموزشی، درمانی، مسکونی و سایر زیرساختهای غیرنظامی، بهوضوح دلالت بر آن دارد که هدف از این اقدامات، صرفاً محدود به مقابله با اهداف نظامی نبوده، بلکه برخلاف اصول مسلم و غیرقابل تردید حقوق بشردوستانه بینالمللی، در جهت ایجاد رعب و وحشت در میان جمعیت غیرنظامی، تحمیل خسارات گسترده به تأسیسات و زیرساختهای حیاتی و فراهم آوردن زمینه بیثباتی و اخلال در نظم عمومی کشور صورت پذیرفته است.
در همین راستا، تهدید اخیر آقای دونالد ترامپ، رئیسجمهور ایالات متحده آمریکا، مبنی بر هدف قرار دادن زیرساختهای غیرنظامی تولید انرژی، نمونهای آشکار از اتخاذ مواضع و رفتارهایی است که در بالاترین سطوح رسمی، مغایر با تعهدات منشور ملل متحد ابراز میگردد؛ رفتاری که میتواند از مصادیق روشن جنایات جنگی تلقی شده و ناقض صریح تعهدات ناشی از کنوانسیونهای چهارگانه ژنو ۱۹۴۹، پروتکلهای الحاقی آنها و نیز قواعد مسلم عرفی حقوق بینالملل بشردوستانه باشد.
با عنایت به تعهد عام و الزامآور تمامی اعضای سازمان ملل متحد نسبت به رعایت و اجرای مفاد منشور، از جمله الزامات مندرج در ماده ۱۰۳ آن، و نیز با توجه به جایگاه ممتاز حقوق بشردوستانه بینالمللی بهعنوان یکی از والاترین دستاوردهای وجدان حقوقی جامعه بشری ــ بهویژه کنوانسیون چهارم ژنو ۱۹۴۹ در حمایت از اشخاص غیرنظامی در زمان مخاصمات مسلحانه، کنوانسیون ۱۹۵۴ لاهه در خصوص حمایت از اموال فرهنگی در زمان مخاصمات مسلحانه، و قواعد عرفی بینالمللی که تعرض به اشخاص و اموال غیرنظامی را بهصراحت ممنوع میدارد ــ و همچنین با لحاظ مخاطرات ناشی از استمرار تعرض به تمامیت ارضی ایران و کوشش در جهت کشاندن سایر کشورها به این مخاصمه غیرقانونی علیه ایران که میتواند پیامدهایی جبرانناپذیر و فاجعهبار برای منطقه و صلح و امنیت جهانی در پی داشته باشد، این کانون از جنابعالی مصرّانه درخواست مینماید:
ضمن محکوم نمودن صریح اقدامات متجاوزانه مزبور، و با لحاظ حق ذاتی دفاع مشروع جمهوری اسلامی ایران وفق ماده ۵۱ منشور ملل متحد، در اجرای اختیارات مقرر در ماده ۹۹ منشور، موضوع را بیدرنگ به شورای امنیت سازمان ملل متحد ارجاع فرمایید و با بهکارگیری تمامی ظرفیتها و ابتکارات حقوقی، سیاسی و دیپلماتیک در حدود صلاحیتهای آن مقام عالی، تدابیر عاجل و مؤثر لازم را برای جلوگیری از هدف قرار گرفتن پالایشگاهها، تأسیسات انرژی و سایر زیرساختهای غیرنظامی اتخاذ نمایید؛ چه آنکه تداوم چنین اقداماتی، جز تشدید آلام انسانی، افزایش رنج و مخاطرات متوجه غیرنظامیان و گسترش بحران در سطح منطقهای و بینالمللی، حاصلی در بر نخواهد داشت.
مستدعی است جنابعالی، در ایفای مسئولیت خطیر خویش در صیانت از اهداف و اصول منشور ملل متحد و حمایت از موازین مسلم حقوق بینالملل، توجه و اقدام شایسته و مقتضی مبذول فرمایید.

Your Excellency,
I wish to extend my sincere greetings and warmest congratulations on the arrival of spring and the Iranian New Year. On the threshold of this new season, we express our hope for the establishment and advancement of peace, security, freedom, and justice for all nations of the world.
As previously communicated in our earlier correspondence, the military actions by the United States of America and the Israeli regime against the Iranian people constitute, under international law, a clear violation of the peremptory principles and rules governing the international legal order—most notably the prohibition on the use of force enshrined in Article ٢ (٤) of the United Nations Charter. At the same time, these actions betray a conspicuous disregard for the fundamental purposes and principles of the United Nations, including the provisions of Article ١ (١) and Article ٣٣ (١) of the Charter. Furthermore, the nature and consequences of these actions are inconsistent with the standards set forth in Article ٨ bis of the Rome Statute of the International Criminal Court.
As the oldest professional, civil, and independent bar association in Iran—founded on the rule of law, the independence of the legal profession, and the defense of legal and humanitarian principles—the Central Bar Association deems it its duty to bring to your attention its profound concern and serious protest over the continuation of these unlawful actions and their devastating impact on regional and international peace and security.
There is no doubt that the initiation and prolongation of war represent a breach of one of the most fundamental obligations of states in contemporary international law: the duty to uphold international peace and security. Attacks on educational institutions, medical facilities, residential areas, and other civilian infrastructure clearly indicate that the objective of these actions is not limited to countering military targets. Rather, in contravention of the established and incontrovertible principles of international humanitarian law, they aim to spread terror among the civilian population, inflict widespread damages on vital facilities and infrastructure, and create the conditions for instability and disruption of public order.
In this same vein, the recent threat by Mr. Donald Trump, President of the United States, to target civilian energy infrastructure stands as a stark example of positions and conduct, expressed at the highest official levels, that contravene the commitments set out in the United Nations Charter. Such conduct may be considered a clear instance of war crimes and constitutes a direct violation of the obligations arising from the four Geneva Conventions of ١٩٤٩ and their Additional Protocols, as well as the well-established customary rules of international humanitarian law.
Considering the universal and binding obligation of all United Nations Member States to respect and implement the provisions of the Charter—including the requirements of its Article ١٠٣—and given the preeminent status of international humanitarian law as one of the highest achievements of the legal conscience of the international community—particularly the Fourth Geneva Convention of ١٩٤٩ for the protection of civilians in times of armed conflict, the ١٩٥٤ Hague Convention for the Protection of Cultural Property in the Event of Armed Conflict, and customary international law which explicitly prohibits attacks on civilians and civilian property—and also in light of the dangers posed by continued aggression against Iran's territorial integrity and efforts to draw other countries into this unlawful conflict against Iran, which could have catastrophic and irreparable consequences for the region and for global peace and security, t he Association earnestly requests Your Excellency to:
Unequivocally condemn the aforementioned aggressive actions; and, mindful of the Islamic Republic of Iran’s inherent right t
o self-defense under Article ٥١ of the United Nations Charter, refer the matter without delay to the United Nations Security Council in exercise of the powers conferred by Article ٩٩ of the Charter. Furthermore, utilizing all capacities and legal, political, and diplomatic initiatives within the scope of your high office, please take the urgent and effective measures necessary to prevent the targeting of refineries, energy facilities, and other civilian infrastructure. The continuation of such actions will only result in further human suffering, increased risk to civilians, and the expansion of the crisis at both the regional and international levels.
We respectfully urge Your Excellency, in fulfilling your critical responsibility to safeguard the purposes and principles of the United Nations Charter and to uphold the established standards of international law, to accord this matter your appropriate and due attention and action.
